O R D E R

Petition is filed seeking direction to the Investigating Agency, who is investigating the complaint of the petitioner in Crime No.232 of 2023 dated 25.10.2023 to conduct further investigation based on the CCTV footage furnished by him.

2. According to the petitioner, though more than 5 persons involved in the criminal trespass and damaged the property, police has registered complaint only against three persons inspite of providing CCTV footage which shows involvement of more than five persons.

3. The learned Government Advocate (Crl. Side) submitted that, the complaint by the petitioner herein against three known persons and others been taken up for investigation and the said investigation is yet to be completed. If CCTV footage discloses any other persons, other than the persons named in the FIR, they will also be shown as accused by filing on final report.

4. In the light of the above submissions, this Court is of the view that no direction for further investigation is required. Respondent Police shall consider the CCTV footage provided by the defacto complainant and proceed with investigation as per the lead provided in the CCTV footage.

5. Accordingly, this Criminal Original Petition is disposed of. 27.11.2023 Index : Yes/No Sma 3/4
