O R D E R

(The order of the Court was made by J.Nisha Banu,J.) This Writ Petition has been filed, challenging the order dated 08.05.2025 passed by the 2nd respondent in proceedings No.918/R1/2024, whereby the representation of the petitioner, seeking grant of leave to her daughter/ Convict Prisoner, was rejected.

It is the case of the petitioner that she is the mother of the Life Convict, namely, Jayalakshmi, D/o Ranganathan, aged 36 years, Convict No.946, PID 287233 and her daughter has been undergoing life imprisonment in connection with the judgment passed in S.C.No.286 of 2014 on the file of the Special Court for Exclusive Trial of cases Under POCSO Court, at Chennai. The representation dated 17.04.2025 given by the petitioner for grant of 30 days leave to her daughter was rejected by the 2nd respondent vide order impugned herein. It is the further case of the petitioner that she is affected by bronchial blockage and undergoing 2/6

treatment and the presence of her daughter is very much necessary to mobilise funds for her treatment and to arrange funds for the livelihood of their family and to take her to hospital visits.

Learned Additional Public Prosecutor has stated that the petitioner's daughter is inside prison for nearly 5 years and that on earlier occasions, 21 days ordinary leave was granted from 05.08.2024 to 25.08.2025 and only in the month of February, 2025, 6 days emergency leave was granted from 04.02.2025 to 09.02.2025 and therefore, objected for grant of leave.

4. Considering the fact that the convict is inside prison for nearly 5 years and that the petitioner/mother is unwell and the presence of the petitioner is necessary to take care of her ailing mother/petitioner, we are inclined to grant leave for a period 15 days without escort to the Convict.

Accordingly, we direct the respondents to grant ordinary leave to the petitioner's daughter/ Life Convict, namely, Jayalakshmi, D/o Ranganathan, Convict No.946, PID No.287233, confined in the Central Prison, (Special Prision for Women) Puzhal,Chennai, for a period of 15 days from 10.10.2025 to 25.10.2025 (by excluding the day on which the 3/6

Convict is released from the prison) without escort, subject to the usual / other conditions that may be imposed by the respondents. The life convict shall report before the jurisdictional Police i.e. Nemili Police Station, daily at 10.00 a.m. The Convict shall be released from the prison at 10.00 a.m. on 10.10.2025 and she shall return back to the prison on or before 05.00 p.m. on 25.10.2025.

6. This Writ Petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed. .
