PRAYER : Criminal Original Petition has been filed under Section 482 of Criminal Procedure Code, to direct the learned I Additional Family Court, Chennai to dispose the case in M.C. ORDER
This petition is filed for expeditious disposal of the Maintenance Case pending on the file of the First Additional Family Court, Chennai in M.C. No.328 of 2018. Since this Court found that Maintenance case filed under Section 125 Cr.P.C requires expeditious disposal which is pending for more than five years, called for the status report from the Presiding Officer. 2. From the report of the Presiding Officer dated 11.12.2023, this Court finds that there was reason for the delay and it is because of this petition filed by the parties and also Application to restore the Original Petition No.810 of 2019 which was disposed of earlier and there was a Revision Petition filed by Wife before the High Court and the said Crl.R.C. No.445 of 2022 was withdrawn on 02.08.2022. The Presiding Officer has also stated that the case will be disposed of expeditiously without any further delay.
3. Recording the same, the petition is disposed of with a direction to the Presiding Officer to complete the trial within a period of three months from the date of receipt of the copy of the order.
