ORDER

The petitioner, who was arrested and remanded to judicial custody on 21.07.2025 for the alleged offence under Sections 5 of the Explosive Substance Act, 1908, r/w.9(B)(1)(b) of Indian Explosive Act, on the file of respondent police, seeks bail.

2. The case of the prosecution is that, the petitioner was in illegal possession of 824 gelatin sticks and 550 detonators without a proper licence. Hence, the case.

3. The learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submits that the petitioner has been suffering incarceration from 21.07.2025. He also submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.

4. The learned Government Advocate (Crl. Side) submitted that the petitioner was in illegal possession of 824 gelatin sticks and 550 detonators without a proper licence and that he has four previous cases, three of which are of a similar nature and one under the Prohibition Act. Hence, he vehemently opposed the grant of bail to the petitioner.

5. Taking note to the gravity of offence, and on considering the bad antecedents, this court is not inclined to grant bail to the petitioner.
