ORDER

Mr.V. Jeevagiridharan, learned Additional Government Pleader takes notice for the 1st respondent and Mr.R. Balaji, learned Standing Counsel takes notice for the 2nd respondent. By consent of both the parties, this writ petition is taken up for final disposal at the admission stage itself.

2. The relief sought in this writ petition is a direction to respondents to consider the petitioner's representations dated 17.10.2024 and 15.04.2025.

3. The petitioner was employed as a Driver in the respondentCorporation and, upon attaining the age of superannuation, retired from service on 31.05.2018. During his service, in the year 2011, an accident occurred resulting in the death of a passenger, for which a criminal case was registered against the petitioner. Pending the said proceedings, a departmental enquiry was conducted and a punishment of stoppage of increment for three years with cumulative effect was imposed from May 2012, which affected his promotion as well. Subsequently, the criminal case ended in acquittal.

4. It is the grievance of the petitioner that, pursuant to acquittal, he is entitled to restoration of the increments and consequential service benefits. In this regard, he submitted representations to the respondents on 17.10.2024 and 2/4

15.04.2025, seeking to set aside the order imposing the punishment. However, till date, no orders have been passed on his representations. Aggrieved by the inaction on the part of the respondents, the petitioner has approached this Court with the present writ petition.

5. Heard the learned counsel on either side and perused the materials available on record.

6. Considering the aforesaid submission, this Court is of the view that it is suffice to direct the respondents to consider the petitioner's representations dated 17.10.2024 and 15.04.2025, and pass appropriate orders on their own merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order. It is made clear that this Court has not expressed any opinion on the merits of the claim made by the petitioner.

7. With the aforesaid directions, this writ petition stands disposed of. No costs.
