Prayer in all the OPs: Criminal Original Petitions filed under Section 482 of Cr.P.C., to quash the proceedings in C.C.Nos.1782, 1781 and 1784 of 2018 respectively, on the file of the learned III Metropolitan Magistrate at George Town, Chennai, against the petitioner/1st accused. O R D E R
All these criminal original petitions filed by the petitioner is to quash the proceedings in the cases filed by the respondents for the offence under Section 138 r/w 141 of Negotiable Instruments Act, against the petitioner, who has been arrayed as accused in all the cases. No representation for the petitioner. Despite service of notice on the respondents and name also being printed in the cause list, none appeared on behalf of the respondents. Therefore this Court with the available materials is inclined to dispose of all the criminal original petitions, since they are being filed to quash the proceedings in the cases filed for the offence under the provisions of the Negotiable Instruments Act. Even though, the respondents/complainants sent statutory notice to 2/4
the petitioner, the petitioner has not sent any reply, which shows that the petitioner has no defence. Further the grounds taken by the petitioner in these criminal original petitions also are not sufficient to quash the proceedings. Therefore this Court is not inclined to grant the prayer sought for by the petitioner.
Accordingly, all the criminal original petitions are dismissed. Consequently connected miscellaneous petitions are closed. However, the petitioner is at liberty to take all their defence, if any available, during enquiry, before the Court below.
