PRAYER: This petition has been filed under Article 226 of Constitution of India, to issue a Writ of Mandamus directing the 1st and 5th respondents to consider the petitioners representation dated 08.08.2025 and conduct enquiry within a stipulated time and include the petitions name in the legal heir certificate dated 28.03.2024 issued by the 4th respondent and issue a fresh legal heir certificate by including the petitioner as one of the legal heirs of Late. J.Munusamy.

ORDER

This petition has been filed seeking a direction to the 1st and 5th respondents to consider the petitioners representation dated 08.08.2025 and conduct enquiry within a stipulated time and include the petitions name in the legal heir certificate dated 28.03.2024 issued by the 4th respondent and issue a fresh legal heir certificate by including the petitioner as one of the legal heirs of Late. J.Munusamy.

2. It is the case of the petitioner that based on the fraudulently obtained legal heir certificate, the petitioners brother, without consent as a legal heir, executed a sale deed in favour one Karunakaran. Hence, the petitioner made a representation to the respondent requesting the cancellation of the legal heir certificate and requesting the cancellation of the sale deed based on the said legal heir certificate and the cancellation of the new patta issued in favour of the

third party. There was no reply or consideration from the respondents. Hence, the present writ petition.

3. The learned counsel for the petitioner submitted that this Court may direct the respondents to consider and pass orders on the petitioners representation within the stipulated time as fixed by this Court.

4. The learned Additional Advocate General appearing for the respondents submitted that the representation will be considered and orders will be passed within the stipulated time as fixed by this Court.

5. Heard the learned counsel for the petitioner and the learned AAG appearing for the respondents and perused the materials.

6. Considering the facts and circumstances of the case and in view of the limited request sought for by the petitioner, this court directs the 4 th respondent to consider and pass orders on the petitioner's representation dated 03.03.2025, after providing opportunity to all the necessary parties, within a period of four weeks from the date of receipt of a copy of this order.

7. With the above directions, the writ petition is disposed of. No costs. 24-09-2025 rli
