CMP No.26306 of 2023 in CMA SR No.144903 of 2023 N.ANAND VENKATESH,J Notice has been served on the respondents. The fifth respondent - Insurance Company is represented through a counsel. Though the names of respondents 1 to 4 are printed in the cause list, they have not appeared either in person or through a counsel.

2. This civil miscellaneous petition has been filed seeking to condone the delay of 195 days in filing the main civil miscellaneous appeal.

3. Heard the learned counsel for the petitioner and the learned counsel for the fifth respondent and perused the records.

4. Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the civil miscellaneous petition is allowed and the delay of 195 days is condoned.

5. It is made clear that for the period of delay of 195 days, the petitioner/appellant will not be entitled for any interest in the event of this Court enhancing the amount of compensation fixed by the Tribunal below.

6. Registry is directed to number the main civil miscellaneous appeal and list the same for admission. When the matter is posted for admission, the name of learned counsel for fifth respondent shall also be printed in the https://www.mhc.tn.gov.in/judis cause-list.
