PRAYER: This writ petition is filed under Article 226 of Constitution of India, to issue a writ of Mandamus directing the respondents to allow the petitioner to bring her disability child Mr.S.V.Hariharan to the School premises during her working days by considering her representation dated 19/08/2025. ORDER
This petition has been filed seeking a direction to the respondents to allow the petitioner to bring her disability child Mr.S.V.Hariharan to the School premises during her working days by considering her representation dated 19/08/2025.
2. It is the case of the petitioner that the petitioner, is employed as a B.T. Assistant Teacher at Lalapettai Government Higher Secondary School. She has a differently abled son, viz., Hariharan, who suffers from multiple disabilities. From 2012 onwards, the child was admitted to school, where his health condition showed improvement due to daily routine. After Covid, However, the petitioner's son completed his school education in the year 2024-25, his mental and physical condition does not permit him to pursue higher studies or remain alone at home. Hence, the petitioner has made a representation dated 19.08.2025 to the respondents to allow the petitioner to bring her disable child to the school premises during her working days and the same is not considered
and hence, the present writ petition has filed.
3. The learned counsel for the petitioner submitted that this Court may issue a direction to the second respondent to consider the petitioner's representation and pass appropriate orders within the stipulated time as fixed by this Court.
4. The learned Special Government Pleader submitted that the petitioner's representation will be considered and pass appropriate orders, within the stipulated time as fixed by this Court.
5. Heard the learned counsel for the petitioner and the learned special Government Pleader appearing for the respondent and perused the materials available on record.
6. Considering the facts and circumstances of the case and having regard the submissions made by the learned counsel on either side, this Court directs the second respondent to consider the representation of the petitioner dated 19.08.2025 and pass orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
