Respondent(s) PRAYER To set aside condition in para-7 to deposit the original title deeds not less the value of Rs.5,00,000/- (Rupees Five Lakhs Only) and consequently direct and learned special judge for trial under the prevention of corruption act, coimbatore to return the original title deeds deposited by the petitioner in crime no.13/2022/AC/CB on the file of the respondent in Crl.O.P. 26470/2022 order dated 01.11.2022.

ORDER

This petition has been filed seeking return of the title deeds deposited by the petitioner in Crime No.13/2022/AC/CB, based on the order passed by this Court in Crl.OP No.26470 of 2022 dated 01.11.2022, on the ground that the respondent police have completed the investigation and filed the final report closing the case as a mistake of fact.

2.The learned Government Advocate (Crl.side) for the respondent police reports that it is true that they have completed the investigation and the final report is yet to be filed. Since final report is yet to be filed, this Court is not inclined to grant the relief as prayed for in this petition. 3.Accordingly, this Criminal Miscellaneous Petition is dismissed. However, the petitioner is at liberty to file an appropriate petition before the trial Court once the final report is filed reflecting closure of the case as a mistake of fact.
