O R D E R
(through Video Conference) This Writ Petition has been filed praying to issue a Writ of Mandamus, forbearing the 1st respondent from interfering in the civil dispute between the petitioner company and the respondents 2 and 3 based on the false criminal complaint dated 09.10.2018 filed by the 2nd respondent which is pending before the 1st respondent.
2.Heard Mr.AR.L.Sundaresan, learned Senior Counsel for the petitioner and Mr.S.Karthikeyan, learned Additional Public Prosecutor appearing for the first respondent police, Mr.R.S.Jeevarathinam, learned Counsel appearing for the second respondent, Mr.D.R.Sivakumar, learned Counsel for the third respondent and Mr.S.Rajmakesh, learned Counsel for the fourth respondent.
3.Today, when the petition is came up for hearing, the learned Additional Public Prosecutor appearing for the first respondent police, on instructions, would submit that in respect of the complaint dated 09.10.2018 filed by the second respondent, the first respondent herein initiated enquiry wherein, both the parties agreed to settle their dispute by appointing an auditor. In this regard, in respect of the closure of enquiry, notice was sent to second respondent on 26.08.2019. Further, in respect to the closure of enquiry, Mr.D.Venkateshan, Inspector of Police, Central Crime Branch, EDF - I, Team - I, Vepery, Chennai has filed an affidavit and the same is recorded.
4.Hence, in view of the above, since already enquiry initiated by the first respondent police has been closed, nothing survives for further adjudication in this matter. Accordingly, this Writ Petition is closed without any prejudice to the rights having by the either parties. Consequently,
