PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the first respondent to dispose the Revision Petition filed by the petitioner on 21.04.2022 within the stipulated time frame and pass orders. .

ORDER

This Writ Petition has been filed seeking a writ of Mandamus seeking to dispose the Revision Petition filed by the petitioner on 21.04.2022 and pass orders.

2. Mr. A. Anandan, Government Advocate takes notice for the Respondents. In view of the consent expressed by the learned counsel appearing for either side, this petition is taken up for final disposal.

3. The case of the petitioner is that the petitioner who was holding the post of Sub-Registrar in the Co-operative Housing Department has committed certain irregularities such as he has sold three properties belonging to the fourth respondent without getting the market value and he has paid more salary to the office Assistant, due to which the 4th respondent has issued a charge memo in Rc.2343/2010 dated 30.11.2011. by the 4th respondent. Challenging the same the petitioner preferred an appeal before the second respondent on 25.02.2014. However, there is no progress in the Appeal and the same is pending till date. Hence this petition.

4. The learned counsel for the petitioner submitted that it would be suffice if this Court issues a direction to the second respondent to dispose of the Appeal Petition filed by the petitioner on 25.02.2014 and pass orders.

5. The learned Government Advocate appearing for the respondents submitted that they will consider the case of the petitioner and take action in the manner known to law.

6.Considering the facts and circumstances of the case, this Court directs the second respondent to dispose the Appeal Petition filed by the petitioner on 25.02.2014 after conducting an enquiry by affording reasonable opportunity of hearing to the petitioner as well as the concerned parties and pass orders within a period of sixteen weeks from the date of receipt of a copy of this Order.

7. With the aforesaid direction, this Writ Petition stands disposed of. No costs.
