O R D E R

Challenging the demand notice issued by the respondent, the petitioner has filed the present Writ Petition.

It is the case of the petitioner that though the petitioner had sought for One Time Settlement with regard to the Educational Loan availed by the petitioner from the respondent bank by way of a representation dated 29.03.2025, however, without considering the same, the present impugned demand notice has come to be issued by the respondent bank directing the petitioner to settle the entire outstanding dues to the tune of Rs.7,00,950/-. Aggrieved by which, the petitioner has come up with the present Writ Petition.

Learned counsel appearing for the petitioner submitted that though the petitioner had sought for closure of loan by way of One Time Settlement, however, without considering the same, the present demand notice has come to be issued by the respondent bank claiming exorbitant rate of interest which is not sustainable and therefore, this Court may issue a direction to the respondent bank to consider the OTS proposal given by the petitioner and pass appropriate orders on the same.

4. Learned standing counsel appearing for the respondent bank submitted that payment for One Time Settlement will commence on 01.10.2025 and on that date, the OTS proposal given by the petitioner will be considered and appropriate orders will be passed within a period of two weeks.

Taking note of the stand taken by the learned standing counsel appearing for the respondent bank, the respondent bank is directed to consider the OTS proposal given by the petitioner from the date of commencement of consideration of OTS and pass appropriate orders on the same within a period of two weeks from the date of receipt of a copy of this order.

6. This Writ Petition stands disposed of with the aforesaid direction. There shall be no order as to costs. Consequently, connected Miscellaneous Petitions are closed.
