O R D E R
The petitioner, who was arrested and remanded to judicial custody on 24.03.2025, for the alleged offence punishable under Sections 5(I), 5(m), 1/6
5(n) r/w 6 of Protection of Children from Sexual Offence Act, 2012 in Crime No.20 of 2025, registered on the file of the respondent, seeks bail.
2. On reading of the First Information Report, it is seen that the petitioner is the sister's husband of the defacto complainant. On the date of the alleged occurrence, the defacto complainant was staying in the residence of the petitioner/accused along with her 10 years old son. The complaint clearly indicates that the petitioner had sexually misbehaved with the minor boy and had committed aggravated penetrative sexual assault. Hence, a case has been registered by the respondent police.

The learned Government Advocate (Crl.Side) appearing for the respondent police opposed for the grant of bail to the petitioner, stating that after recording the statement of the witnesses, the final report has been filed and taken on file by the Sessions Judge, Magalir Needhi Mandram, (Fast Track Court), Tiruppur in Spl.S.C. No.147 of 2025. He further submitted that the trial has been posted on 15.09.2025 for examination of witnesses.
4. Taking note of the fact that the petitioner and the defacto 2/6
complainant are relatives and that the defacto complainant had gone to the house of the petitioner and was staying there during the alleged occurrence, and considering the period of incarceration already undergone by the petitioner and the investigation was also completed, this Court is inclined to grant bail to the petitioner, subject to certain conditions.

Accordingly, the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Sessions Judge, Magalir Needhi Mandram, (Fast Track Court), Tiruppur, Tiruppur District, and on further conditions that: [a] the sureties shall affix their photographs and Left Thumb Impression in the Application for Surety ship [Judicial Form No.46 annexed to 'The Criminal Rules of Practice, 2019']. The learned Magistrate shall obtain a copy of any one of the identity proofs to ensure their identity;
[b] the petitioner shall report before the Sessions Judge, Magalir Needhi Mandram, (Fast Track Court), Tiruppur on every Monday at 10.30 a.m, till the completion of the trial;

[c] On breach of any of the aforementioned conditions, the learned Magistrate/Trial Court is entitled to pass appropriate orders against the petitioner in accordance with law as if the aforementioned conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)13 SCC 283];
[d] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 of B.N.S. 03.09.2025 drl Note :
