Maya Appliances Private Limited v. Ramakrishna Metal Stores

Application No.5939 of 2023 ABDUL QUDDHOSE, J.

The suit has been filed for infringement of patent. The infringed products are being sold at Chennai by the first respondent/first defendant. However, the defendants 2 and 3 are having its place of business outside the jurisdiction of this Court. In such circumstances, this application has been filed seeking to grant leave to sue the respondents 2 and 3. Since a part of cause of action has arisen within the jurisdiction of this Court, this Court is inclined to grant leave to sue as prayed for. Accordingly, this application is allowed as prayed for. Registry is directed to number the suit if it is otherwise in order and list the same for hearing on 10.11.2023.
