(Order of the Court was made by C.V.Karthikeyan, J.) This petition has been filed seeking to condone the delay of 211 days in filing the above first appeal.

2.It is contended by the learned counsel for the appellants that the sole defendant had died on 03.06.2021. But however, the Trial Court had proceeded to pass a preliminary decree on 20.12.2023 without impleading the legal heirs of the sole defendant, the present petitioners/appellants.

3.Notice had been directed to the respondent and the learned counsel had entered appearance.

4.We have examined the reasons stated and we are convinced with the reasons given. The delay stands condoned. Registry is directed to number the appeal, if it is otherwise in order and list the appeal for admission. Registry may also print the name of the counsel for the respondent in the cause list when the appeal is posted for admission.
