C.M.P.No.1335 of 2023 in C.M.A.SR.No.759 of 2022 N.MALA,J, This Petition has been filed to condone the delay of 1475 days in filing the above appeal against the order dated 09.08.2017 made in M.C.O.P.No.5512 of 2013, on the file of the Motor Accidents Claims Tribunal, (Chief Judge, Small Causes Court), Chennai.

2. Mr.M.Muralivinodh, the learned counsel appearing for the sole respondent submits that he has no objection to condone the delay, but the appellant is not entitled for any interest for the delay period of 1475 days.

3. The learned counsel for the appellant submits that that he is prepared to waive the interest for the delay period of 1475 days.

4. Accordingly, the delay of 1475 days is condoned, subject to the condition that the appellant will not be entitled to interest for the delay period of 1475 days in filing the appeal.

5. Registry is directed to number the Civil Miscellaneous Appeal, if it is otherwise in order and post the same 'for admission'.

Accordingly, this CMP is ordered.
