This Civil Miscellaneous Petition has been filed to grant an order of injunction restraining the respondent and his men and agents from any manner encumbering or alienating the suit schedule properties which is the subject matter of O.S.No.34 of 2010 on the file of Subordinate Judge, Udumalpet, pending disposal of the above second appeal.

2. The learned counsel for the respondent/caveator would submit that all along the petitioners/appellants were not granted any interim order in respect of the suit property. That apart, the learned counsel for the respondent would submit that the present application is filed to restrain the respondent from alienating the suit schedule property and that they are not going to alienate the suit schedule property.

3. Recording the said submission, this Civil Miscellaneous Petition is dismissed.
