PRAYER:

Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the Hon'ble Principal District Judge, Chengalpat to dispose and pass orders on merit in Crl.M.P.No.3211 of 2019, within the stipulated period of time and thereafter hear the Crl.Appeal No.82 of 2017. For Petitioner : Mr.G.Prabhakar For Respondent : Mr.C.Iyyapparaj Additional Public Prosecutor

O R D E R

The limited prayer sought for in the present petition is for a direction to the learned Principal District Judge, Chengalpat, to dispose of the petitioner's application under Section 391 Cr.P.C expeditiously.

2. The learned Additional Public Prosecutor appearing for the respondent submitted that by an earlier order dated 31.07.2019 passed in Crl.O.P.No.20519 of 2019, this Court had directed the criminal appeal in Crl.A.No.82 of 2017 to be disposed of, within a period of three months from the date of receipt of a copy of the order. While that being so, it would be appropriate that the petitioner's application also be disposed of, within the time stipulated by this Court in the aforesaid order.

3. In the light of the above observation, there shall be a direction to the learned Principal District Judge, Chengalpat, to dispose of the petitioner's application in Crl.M.P.No.3211 of 2019, within the time stipulated by this Court in its earlier order dated 31.07.2019 in Crl.O.P.No.20519 of 2019.

4. It is made clear that this Court has not expressed any of its views with regard to the merits of the application made under Section 391 Cr.P.C and the mode of pre-disposal.

5. The Criminal Original Petition stands disposed of accordingly.
