O R D E R
This Civil Revision Petition has been filed seeking a direction directing the learned District Munsif cum Judicial Magistrate, Madhavaram to dispose the I.A. 62 of 2019 in O.S. 82 of 2019.
2. Considering the nature of order came to be passed in this Civil Revision Petition, no prejudice would be caused to the respondent. Hence, notice to the respondent is dispensed with.
3. According to the petitioner, he has filed a Suit for permanent injunction against the respondent herein along with application seeking for interim injunction in I.A. 62 of 2019. Even though the application was filed in the month of October 2019, that application was not disposed of by the Trial Court. Hence, the present Civil Revision Petition has been filed.
4. The learned counsel appearing for the petitioner 2/5
submitted that, the learned Judicial Magistrate has often went for training, and the learned Judicial Magistrate No.2, Ponneri took incharge of the said court. Due to want of Judge, the petitioner's application was not disposed of. Now, the respondent is taking steps to interfere with the possession of petitioner, and in view of urgency, the present application has been filed.
5. I have heard and considered the submissions made by the learned counsel appearing for the petitioner and perused the records carefully.
6. Considering the facts and circumstances of the case, without going to the merits of the case, the learned District Munsif cum Judicial Magistrate, Madhavaram is directed to dispose the application in I.A. 62 of 2019 in O.S. 82 of 2019 within a period of two weeks from the date of receipt of the copy of this order. Accordingly, the Civil Revision Petition stands disposed of. No costs. Consequently, the connected Civil Miscellaneous Petition is closed.
