Respondents W.P.No.2568 of 2017 and W.M.P.No.2530 of 2017:- Writ Petition has been filed under Article 226 of the Constitution of India for issuance of a writ of Certiorarified Mandamus to call for the records of the 2nd respondent dated 29.12.2016 vide No.MA.HA-9/VA.THU.NA.KA.No. R1/SIRAPU/2016 culminating in Demand notice bearing Bill No.09-117-10444 -000/ 08-114-1734-000 and quash the same and consequently direct the second respondent to inspect the schedule mentioned premises and reassess the same as a residential property.

This case came up for hearing today before the Lok Adalat. Both the parties are present. Mr.G.Abraham Prabhu, Advocate appeared for the petitioner and there is no appearance for the respondents.

TERMS OF SETTLEMENT The writ petitioner and his Advocate are present. It is stated that the matter has been settled out of this Adalat Court and necessary endorsement has also been made in the writ petition to that effect.

2. In view of the same, this writ petition is dismissed as settled out of Court. The award is passed accordingly. Consequently, the connected miscellaneous petition is closed.

3. The full Court fee paid shall be refunded to the petitioner in the manner provided under Section 69-A of the Tamil Nadu Court-Fees and Suits Valuation Act, 1955 and the Court Fees Act, 1870 as provided for under sub Sec.1 of Section 21 r/w 25 of LSA Act 1987 as amended in 1994 and there shall be no demand for additional Court fee.
