Chandrasekaran for O.L. - - - - This application has been filed seeking leave of this Court to appoint the applicant Mrs.Sherna Irani, the wife of the 2nd respondent in the place of Farouk M. Irani as his next friend in respect of C.A. No.276 of 2024 and permit the applicant to file necessary affidavits and documents on behalf of Farouk M. Irani.
2. Supporting documents have been filed along with this application to prove that Farouk M. Irani. is suffering from serious neuro 1/3
disorder and due to the same, he is not in a position to sign documents / affidavits before this Court.
3. Adequate averments have been made in the affidavit filed in support of this application seeking for the reliefs as prayed for in this application. Even though counter affidavit has been filed by the respondent / Official Liquidator, this Court after giving due consideration to the documents filed along with this application, which includes, Neuropsychological reports, dated 30.06.2022 and 03.09.2024, is inclined to grant the relief as prayed for in this application. Accordingly, Comp. A. No.466 of 2024 is allowed as prayed for. Accordingly, Mrs.Sherna Irani, the wife of the 2nd respondent is appointed as the next friend of the 2nd respondent in respect of C.A. No.276 of 2024 and Mrs. Sherna Irani is permitted to file all necessary affidavits and documents on behalf of Farouk M. Irani in this application.
4. On a request made by Mrs.Sherna Irani, the respondents are directed to serve copies of all the supporting documents filed along with C.A. No.276 of 2024.
