The petitioner seeks bail in Crime No.158 of 2023, registered by the respondent police for the offences punishable under Section 24(1) of COTPA Act r/w Section 328 of IPC. The petitioner had been taken into custody on 25.10.2023.

2.It is the case of the prosecution that the petitioner was found in possession of 105 kgs of banned tobacco products in his house. The contraband had been seized.

3.Taking into consideration the large quantity of banned tobacco products seized and particularly because the source of product will have to be determined by the respondent, even though it is stated that there is no previous case pending against the petitioner, I am not inclined to grant bail to the petitioner herein. Accordingly, this Criminal Original Petition stands dismissed.
