The respondent has been duly served in this application through Substituted Service effected by the plaintiff. The name of the respondent is also printed in the cause list today. The applicant / plaintiff is having the benefit of an interim order in A. No.4218 of 2023, wherein, this Court directed the respondent to furnish security to the extent of the suit claim i.e., Rs.2,03,53,211/- on or before 14.09.2023. Till date, the respondent / defendant has not furnished security as directed by this court on 17.08.2023. Despite effecting Substituted Service, no one has entered appearance on behalf of the respondent / defendant. The respondent / defendant is therefore set exparte by this Court in this application. Since the security has not been furnished by the respondent / defendant in terms of the order, dated 17.08.

2023 passed by this Court in this application, the consequential order of attachment as prayed for in this application has to be granted in favour of the applicant / plaintiff. Accordingly A. No.

Summons is attached.

Since the suit summons sent to the defendant has been returned "Unserved", fresh summons is ordered to the defendant, returnable by 04.04.2024.
