KRISHNAN RAMASAMY.J., When this matter came up for hearing on 02.02.2022, after hearing the learned counsel appearing for both the sides, this Court passed the following order:

"The learned Government Advocate appearing for the respondents would submit that pursuant to the order passed by this Court dated 15.11.2021, the petitioner has presented a fresh application and the same was rejected by the first respondent stating that the Income Certificate produced by the petitioner is for a sum of Rs.36,000/- whereas, the eligibility for availing the benefit under the Moovalur Ramamirtham Ammaiyar Ninaivu Marriage Assistance Scheme is for a sum of Rs.24,000/-.

2. However, the learned counsel appearing for the petitioner submits that they have not received any communication from the respondents. Hence, the learned Special Government Pleader appearing for the respondents is directed to serve the copy of the letter issued by the District Collector / first respondent to the petitioner within a period of two weeks from the date of receipt of a copy of this order.

3. It is open to the petitioner to challenge the said letter issued by the first respondent dated 28.01.2022 in Na.Ka.No.107/A1/2016. Hence, no further order is required."

Mr.M.Shahjahan, learned Special Government Pleader requested this Court to list this matter for 'being mentioned' today since on earlier occasion, by inadvertance, he mentioned that the income limit to avail the benefit under the Moovalur Ramamirtham Ammaiyar Ninaivu Marriage Assistance Scheme is for a sum of Rs.24,000/- instead of Rs.72,000/-. According to him by way of subsequent Government Order, the income limit has been increased to Rs.72,000/-. This fact was not brought to the notice of this Court while passing the above order.

In the present case, the Income Certificate furnished by the petitioner is for a sum of Rs.36,000/- however, so far, the petitioner's request for grant of the marriage assistance benefit, was not considered.

This Court vide order dated 15.11.2021, directed the petitioner to present a fresh application along with Income Certificate within a period of two weeks and the petitioner also presented the application as per the direction of this Court. However, it is unfortunate to note that the said application was rejected on the ground that the petitioner has presented the

application after a period of 5 years. Since this Court directed the petitioner to present the fresh application, on that basis only he has filed an application. In such an event, the decision taken by the respondents is not inconsonance with the order passed by this Court.

4. Therefore, this Court directs the respondents to consider the application filed by the petitioner for grant of the Marriage Assistance, and pass appropriate orders, within a period of four weeks from the date of receipt of a copy of this order.
