ORDER

This Criminal Original Petition has been filed to direct the respondents police to register the FIR on the complaint dated 08.08.2022 investigate the matter and file the final report as per the order dated 16.11.2022 passed in Crl.M.P.No.33651 of 2022 on the file of the learned Metropolitan Magistrate CCB & CBCID Court, Egmore, Chennai.

The learned counsel appearing for the petitioner submitted that despite the order passed by the learned Metropolitan Magistrate CCB & CBCID Court, Egmore, Chennai in Crl.M.P.No.33651 of 2022 dated 16.11.2022 to investigate the matter and file the final report, the third respondent has not registered a case till now. Therefore, the third respondent police may be directed to register the case, based on the compliant given by the petitioner.

3. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that, after receipt of complaint dated 08.08.2022 from the petitioner, the third respondent police had conducted enquiry in C.S.R No.453 of 2022 and it is pending for further investigation.

4. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) for the respondents.

5. On going through the order of the learned Magistrate, it appears that the learned Magistrate having prima facie satisfied, had directed the Deputy Commissioner of Police to register the FIR on the basis of the complaint given by the petitioner. Even thereafter, the complaint was not registered. It appears that the order of the learned Metropolitan Magistrate CCB & CBCID was not complied with so far. Therefore, the petitioner is directed to approach the learned Metropolitan Magistrate for further appropriate direction regarding the non compliance of the order.
