ORDER

This petition has been filed to appoint and declare the petitioner as Guardian of Person of the Minor daughter Mahika N Methal born on 10.11.2020, aged about 4 years until she becomes major and to grant permanent custody of the minor daughter to the petitioner herein.

2. When the matter is taken up for hearing, the learned counsel for the petitioner submitted that both the petitioner and the respondent are now living together. However, this petition was filed when the respondent attempted to take away the child from the petitioner and to live separately in the second floor of the same building in which the petitioner resides.

3. Learned counsel appearing for the respondent acknowledges the statement made by the learned counsel for the petitioner that the petitioner and the respondent are living together.

4. Since the petitioner and the respondent are living together and the child is in custody of the petitioner and the respondent, nothing survives for further adjudication. 5.
