O R D E R
This Writ Petition has been filed for issuance of a Writ of Mandamus directing the respondents to pay the sum of Rs.42,44,352 /- (Rupees Forty Two Lakhs Forty Four Thousand Three Hundred and Fifty Two Only) to the petitioner without any further delay in accordance with the Award passed and confirmed by the Respondents 1 to 3 in Na.Ka. No.05/ 2007 dated 09.07.2021.
2.It is submitted by the learned counsel for the petitioner that acquisition proceedings were initiated by the respondents and vide Na.Ka. No.05/ 2007 dated 09.07.2021, a sum of Rs.42,44,352 /- (Rupees Forty Two Lakhs Forty Four Thousand Three Hundred and Fifty Two
Only) was awarded to the petitioner as compensation. However, till date, the said amount has not been handed over to the petitioner. Therefore, the petitioner/Trust submitted their representation on 05.08.2022 and the same is still pending on the file of the respondents. Hence, the present Writ Petition.
3.Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the respondents and perused the materials available on record. 4.It is seen that the respondents have issued Na.Ka.No.05/ 2007 dated 09.07.2021 recommending a sum of Rs.42,44,352 /- to the petitioner as compensation, in the land acquisition proceedings. Therefore, this Court without expressing any opinion with regard to the merits of the case, directs the respondents to consider the representation of the petitioner dated 05.08.2022 and pay a sum of Rs.42,44,352/-, if the petitioner/Trust is otherwise found eligible, within a period of two months from the date of receipt of a copy of this order.
5.With the above direction, this Writ Petition stands disposed of. No costs.
