Civil Revision Petition is filed under Article 227 of the Constitution of India seeking a direction to the learned IX Assistant Judge, City Civil Court, Chennai to dispose of the E.P.No.1413 of 2012 within a time frame.

ORDER

This revision is filed seeking a direction to dispose of E.P.No.1413 of 2012 in O.S.No.2388 of 2010, pending on the file of the learned IX Assistant Judge, City Civil Court, Chennai, within a time frame.

2. Considering the nature of order to be passed in this revision which will in no way cause any prejudice to the respondents, notice to the respondents is dispensed with.

3. Learned counsel appearing for the petitioner submitted that the decree in the suit has been passed in the year 2012 and thereafter he filed the present execution petition. He further submitted that the second appeal filed by the respondents/ defendants also came to be dismissed in the year 2017 and the respondents were directed to hand over vacant possession on or before 07.01.2018. The petitioner further stated that a stranger filed a petition under Order 21 Rule 97 read with Section 151 of C.P.C. seeking dismissal of the E.P. and the said https://hcservices.ecourts.gov.in/hcservices/

application is pending. In these circumstances, the petitioner filed the present revision seeking early disposal of the E.P. within a time frame.

4. Considering the limited scope of the prayer made in the revision, the learned IX Assistant Judge, City Civil Court, Chennai, is directed to dispose of E.P. and the E.As., on merits and in accordance with law, after giving opportunity to both the parties, within a period of three months from the date of receipt of a copy of this order. This revision is disposed of with the above directions. No costs.
