The present application had been taken out for further extension of time for payment of the 1/3rd amount indicated in the order dated 18.10.2024.

2. The reason that had been assigned by the learned counsel for the applicant is that in view of the impeding holidays, the Board of the Bank which has accepted to extend the loan for the payment would have some difficulty in meeting and therefore two weeks delay is expected for the receipt of the said amount.

3. However, the learned counsel for the applicant would submit that the entire balance amount would be deposited within a period of eight (8) weeks fixed by this Court on 18.10.2024. He would also undertake that no further extension would be sought for by the applicant in making the payment.

4. Considering the statement made by the learned counsel for the applicant and also undertaking that had been given by him on instructions, the payment of 1/3rd ordered by this Court to show the bonafides is recalled.

5. The applicant shall pay the entire amount on or before 06.12.2024, failing the payment of the said amount, the EMD shall stand forfeited. https://www.mhc.tn.gov.in/judis Page No. 1 of 2
