The petitioner herein seeks a direction to 1st respondent to issue passport to the petitioner by considering his application bearing Reference (ARN) No. 24-1009564513 submitted on 29.07.2024 within the time stipulated by this Court.

2. Mr.A.Prakash, learned Additional Central Government Standing Counsel, who takes notice for the 1st respondent, submits that petitioner though applied for passport through online, failed to fix appointment and therefore, the application of the petitioner was not processed.

The learned Government Advocate (Crl.side), who takes notice for the 2nd respondent filed a status report stating that a criminal case is pending against the petitioner in Crime No.254 of 2013 on the file of S-7 Anaikaranchatram Police Station, Mayiladuthurai District under Sections 379 of IPC read with 21(1) of Mines and Minerals Act and the investigation is pending. It is also stated in the status report that till date no charge sheet has been filed.

4. In view of the fact that no charge sheet has been filed against the 2/4

petitioner and only investigation is pending in the crime number, there may not be any impediment for the 1st respondent to process the application submitted by the petitioner. In view of the statement made by the learned Additional Central Government Standing Counsel for the 1st respondent that petitioner failed to seek appointment through online, the petitioner is directed to fix appointment with the 1st respondent through online within a period of two weeks from the date of receipt of copy of this order. The petitioner shall appear before the 1st respondent as per the information furnished in the online portal and the 1st respondent is directed to process the application filed by the petitioner in accordance with law and pass final orders on merits within a period of four weeks from the date of such appointment.

5. With the above directions, this writ petition stands disposed of. No costs.
