4th respondent in respect of the proceedings in Na.Ka.No.A3/1697/2020 dated 04.08.2023 on the file of the 4th respondent and quash the same, subsequently, direct the respondents 1 to 3 to initiate action on the 4th respondent for misappropriation of public fund under the Prime Minister's Awas Yogana Scheme 20172018. ORDER
(Made by the Hon'ble Chief Justice) We have heard Mr.E.Aneesh Vinayak, learned counsel for the petitioner and Mr.A.Edwin Prabakar, learned State Government Pleader, assisted by Mr.T.K.Saravanan, learned Government Advocate for the respondents.
2. On 31.01.2024, we had observed that the writ petition does not appear to be bona fide.
3. Learned counsel for the petitioner submits that large scale malpractice has been conducted. There was a scheme to construct houses for poor persons under the Prime Minister Awas Yojana Scheme. However, in doing that illegalities have been committed and even before the sanction of the amount, houses were constructed and photographs were uploaded. The petitioner had given representation along with photograph of the houses. But, no cognizance is taken.
4. A counter is filed by the fourth respondent. The details of the order of the sanction, the date of work order and the bank accounts where the amounts are deposited are given. The amount has been given in four instalments. The fourth respondent has completed the process by giving fund under the Scheme and the amount has been sanctioned to all the beneficiaries legally.
5. There is nothing on record to conclude about the alleged illegality.
6. In the light of the above, the writ petition is dismissed. There shall be no order as to costs.
