C.M.P.Nos.26639, 26643 and 26646 of 2023 in S.A.No.259 of 2017 R.SAKTHIVEL, J., These petitions have been filed by the petitioners to condone the delay of 592 days in filing the application caused due to the death of the first respondent; to set aside the abatement caused due to the death of the sole respondent; and to bring on record the legal heirs of the deceased first respondent as the proposed respondents 5 to 8 in the above second appeal.
2. Heard both sides.
3. Accepting the reasons stated in the affidavit filed in support of these petitions, this Court is inclined to allow these petitions. Accordingly, these petitions are allowed as prayed for.
4. The Registry is directed to carry out the necessary amendments in the second appeal.
