ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.This case in Cr.No.101 of 2021 was registered for the alleged offences under Section 353 and 506(2) of IPC and 24(1) of CIGARETTE AND OTHER TOBACCO PRODUCTS ACTS 2003. The allegation of this case is that during the covid lockdown period, the defacto complainant police was conducting regular vehicle checkup, when the vehicle of the accused was stopped, he abused and threatened them and also prevented him from doing his duty and was found to be in possession of gudka and 300 packets of banned tobacco products.

3. Considering the fact that the matter is pending in summons stage since 2021 and summons could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon his right to a speedy trial. Due to the passage of time, a meaningful trial is unlikely, and no useful purpose would be served.

shl 4.Accordingly, the case in CC.45/2022 on the file of the District Munsif Cum Judicial Magistrate Court, Gummidipoondi Taluk, Tiruvallur stands quashed. This Suo Motu Transfer Case is disposed of. 23.10.2025 shl electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
