The Criminal Original Petition has been filed to call for the records pertaining to the Impugned FIR in V & AC Crime No.10 of 2022 dated 27.09.2022 pending on the file of the Inspector of Police, Vigilance and Anti corruption, Thiruvannamalai District.
2. Learned counsel for the petitioner would submit that no incident as alleged by the de facto complainant had happened and he is an innocent person and he is no way connected with the alleged offence. Hence he prayed to quash the FIR in V & AC Crime No.10 of 2022.
3. Mr.A.Gokulakrishnan, learned Additional Public Prosecutor would submit that the grounds raised by the petitioner are factual in nature and without any legal points, hence the proceedings cannot be quashed.
4. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor and perused the materials available on record.
5. On seeing the facts of the case it needs detail investigation and there is no material to quash the proceedings. Mere allegation to quash the proceedings is not sufficient which requires material evidence based on the 2/4
record to establish any irregularities.
6. In view of the above, this Court is not inclined to quash the FIR in V & AC Crime No.10 of 2022. Accordingly, this criminal original petition is dismissed. Consequently, connected miscellaneous petition is also closed. 23.01.2023 dsn Index: Yes/No Internet: Yes/No To
