[Order of the Court was made by SUNDER MOHAN, J.] The petitioner seeks modification of the condition imposed by this Court in Crl.R.C. No.1222 of 2015 dated 20.01.2016 directing him to appear and sign before the Deputy Superintendent of Police, Valparai, Coimbatore, daily at 10.30 a.m. and 5.30 p.m., until further orders.

2. The learned counsel appearing for the petitioner submitted that though bail was granted to the petitioner on 20.01.2016 in Crl.R.C. No.1222 of 2015, he could not come out from the prison since another case was pending against him; that the petitioner got bail on 22.08.2023 in Crl.A. No.871/2022 on condition that he should appear and sign before the Trial Court, i.e. Principal District Court, Coimbatore/Special Court designated under Section 22 of NIA Act every day at 10.30 a.m. and he has been complying the same till date and therefore, he could not comply the condition

imposed by this Hon'ble Court in Crl.R.C. No.1222 of 2015. Therefore, he seeks for modification of the condition so that he would appear before the Principal District Judge, Coimbatore, instead of before the Deputy Superintendent of Police, Valparai, Coimbatore, as directed by this Court.

Considering the facts and circumstances of the case and on hearing the learned Additional Public Prosecutor, who has no serious objection, this Criminal Miscellaneous Petition is ordered directing the petitioner to appear before the Principal District and Sessions Court, Coimbatore on all working days at 10.30 a.m. until further orders instead of appearing before the respondent police. It is also submitted that final report has been filed in the case before the trial court. Therefore, it is made clear that the petitioner shall appear before the trial court on all hearing dates. He is exempted from appearing before the Principal District and Sessions Court, Coimbatore, on those dates when he has to appear before the trial court for hearing. (M.S.R., J.)
