PRAYER: Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the third respondent to give immediate protection to the petitioner to fire the wet bricks in the country brick kiln situated at Vatharayanthethu village, Manajakollai Post, Bhuvanagiri Taluk, Cuddalore District.

O R D E R

This Writ Petition has been filed to issue a Writ of Mandamus, to direct the third respondent to give immediate protection to the petitioner to fire the wet bricks in the country brickkiln situated at Vatharayanthethu village, Manajakollai Post, Bhuvanagiri Taluk,

2. Heard the learned counsel appearing for the petitioner and the learned Special Government Pleader and learned Additional Public Prosecutor appearing for the official respondents and perused the materials available on record.

3. Since no adverse order is passed against the private respondents, notice to the private respondent is dispensed with.

4. There is a dispute between the parties with regard to quarrying the sand and making bricks. It is seen that the allegations levelled as against the private respondents by the petitioner are civil in nature. Hence, this Court cannot give a positive direction to the third respondent/Police.

5. In view of the same, the Writ Petition is dismissed. However, the petitioner is at liberty to work out his remedy in the manner known to law. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
