The learned counsel seeks modification of the Para No.5(b) of the order dated 18.10.2023.

2. After hearing the learned counsel, the following sentence may also be incorporated in Para No.5(b).

3. When the learned Judicial Magistrate may hand over a sum of Rs.25,000/- to the de-facto complainant and may be obtained that if the petitioner is acquitted of the offence the de-facto complainant and return back to the said sum of Rs.25,000/- back to the Court and then the Court on the strength of the order of the acquittal may hand over back to the petitioner herein.

4. Fresh order copy to be issued to both the parties.

5. Accordingly, this Criminal Miscellaneous Petition is ordered.
