PETITION under Article 226 of The Constitution of India praying for the issuance of a Writ of Mandamus directing the second respondent to consider the petitioner's representation on 05.8.2024 for patta for the property situated at old No.115, new No.27, Seeranipuram, T.Nagar, Chennai-17.

ORDER

Since his request for the grant of patta made vide representation 1/4

dated 05.8.2024 sent to the second respondent together with all the requisite documents has not been considered, the petitioner is before this Court.

2. Heard the learned counsel for the petitioner and the learned Special Government Pleader accepting notice for the respondents.

3. The petitioner was granted a permanent allotment by the Executive Engineer, World Bank Project, Division 2, Chennai-83 on 18.8.1977 after scrutinizing all the documents. Thereafter, the Special Deputy Collector, Madras Urban Development Project (World Bank) issued the proceedings dated 22.6.1982 calling upon the petitioner to produce documents on 16.7.1982 to prove that he had been granted allotment and had been residing there either as on or before 30.6.1977, failing which, it was made clear that the plot could not be allotted to him.

4. Thereafter, based on the no objection issued by the Tahsildar, Mambalam Guindy Taluk, Chennai-17 dated 03.11.1982, the electricity supply was effected to the premises. Thereafter, the petitioner has been sending representations after representations to the authorities seeking to allot a permanent site. In order to regularize his title, the 2/4

petitioner made a representation dated 05.8.2024 to the second respondent seeking to issue patta in respect of the property situated at old No.115, new No.27, Seeranipuram, T.Nagar, Chennai-17 and this representation is kept on hold. Aggrieved by that, the petitioner is before this Court.

Considering the fact that the representation dated 05.8.2024 has been made for the grant of patta and taking note of the fact that the authorities have already scrutinized the documents, the writ petition is allowed and the second respondent is directed to consider and pass orders on the said representation dated 05.8.2024 and thereafter issue patta to the petitioner. This exercise shall be completed within a period of eight weeks from the date of receipt of a copy of this order. No costs.
