The applications in A.Nos.9752 & 9753 of 2019 are filed to amend the schedule in O.P.No.534 of 2019 by deleting the securities which are set out in the judge's summons and for altering the value of assets in respect of the estate of Y.Harsha Vardhana Prasad from the originally stated value of Rs.38,85,067/- to Rs.38,17,860/-.

2.I heard the learned counsel for the applicants.

3. The learned counsel for the applicants submitted that O.P.No.534 of 2019 was filed for grant of Succession Certificate in respect of the estate of the husband of the first petitioner, namely the deceased Y.Harsha Vardhana Prasad. He further submitted that inadvertently the petitioner included the securities that stand in the name of her father-in-law. Consequently, he submitted that the present applications have been filed to delete the securities set out in the judge's summons and also to alter the value of assets in respect of the estate of Y.Harsha Vardhana Prasad. 1/2

4. Upon considering the submissions of the learned counsel and on examining the affidavit in support of the applications, it is clear that the applicants have inadvertently included the securities owned by the first applicant's late husband's father in the schedule of assets. Consequently, these applications are liable to be allowed.

5.Therefore, these applications are allowed and the applicants are permitted to amend the schedule in O.P.No.584 of 2019 by deleting the securities that are set out in the judge's summons and consequently, to alter the value of the assets specified from Rs.38,85,067/- as mentioned earlier to Rs.38,17,860/-.

6. The applicants are directed to file an amended affidavit of assets by 10.01.2020.

7. As a consequence of the above order, A.Nos.9126 and 9127 of 2019 are closed as not pressed.
