ORDER

Heard the learned counsel for the petitioner and the learned Government Advocate appearing for the respondent.

2. This is a petition filed by the petitioner seeking to direct the respondent to consider his application dated 19.07.2019 to issue patta in his name in respect of plot Nos.13 and 14 comprised in S.Nos.2, 3, 4 and 9 at Amudth Nagar, No.99, Maduravoyal Village, Saidapet Taluk, Chengalput District.

It is the case of the petitioner that he purchased the subject land measuring an extent of 5,100 sq.ft. vide sale deed registered as Doc.No.2441 of 1979 dated 22.6.1979 on the file of the Sub-Registrar, Kodambakkam out of a larger extent of 7 acres and 11 cents. The said larger extent of land was originally owned by one Mr.M.Kothandapani and Mr.M.Venugopal by way of a partition deed dated 30.9.1971 registered as Doc.No.4612 of 1971. The subject land fell to the share of the said Mr.M.Venugopal, after whose demise, his legal heirs executed a power of attorney in favour of one Mr.V.G.Panneerdass and M/s.VGP Housing Private Limited registered as Doc.No.108 of 1978 dated Page No. 2 of 5

29.07.1978, to deal with the subject property. Further, the Town Planning Authorities also granted approval to form a layout in respect of the subject land. Thereafter, on 19.07.2019, the petitioner applied to the respondent for the issuance of patta in his name. However, he could not get fruitful results. Hence the writ petition.

Considering the limited nature of the prayer sought for and without expressing any opinion on the merits of this case, the writ petition is disposed of by directing the respondent to consider the petitioner's application dated 19.07.2019 on merits after giving notice to both the parties, opportunity of personal hearing and to pass appropriate orders on merits and in accordance with law by observing the above principles of natural justice within a period of eight weeks from the date of receipt of a copy of this order.
