This application is filed by the first plaintiff in the suit for granting leave to file the documents listed in the schedule to the judges summons.
2. I heard the learned counsel for the applicant.
3. The learned counsel for the applicant submitted that these documents were traced subsequently and, therefore, could not be filed along with the plaint. He further submits that these documents are vital so as to establish the case of the plaintiff. The learned counsel for the first and second respondents do not have any objection to this application being allowed.
4. Upon considering the submissions of the learned counsel for the applicant and that of the learned counsel for the respondents and on examining the affidavit in support of this application, I am of the view that the applicant has made out a
case for filing the additional documents, which are described in the schedule to the Judges summons. Accordingly, this application is allowed and SENTHILKUMAR RAMAMOORTHY.,J.
Pns leave is granted to the applicants / plaintiffs to file the schedule mentioned documents as exhibits in C.S.No.77 of 2018.
5. The learned Master is directed to conduct the trial on an expeditious basis and day-to-day, if possible, in view of the fact that the first plaintiff resides in the United States of America and is in the Country for a limited duration.
