Petition filed under Article 226 of the Constitution of India to issue a Writ of Certiorarified Mandamus calling for the records made in the impugned order in Na.Ka.No.A3/3806/2021 dated 14.09.2023 passed by the second respondent, quash the same, consequently, direct the first respondent to vacate the tenth respondent from the premises situated at Samathuvapuram, Door No.6/167, Plot No.2, M.Mettupatti Village, Erumaipatti Panchayat Union, Mohanur Taluk, Namakkal District and hand over the physical possession to the petitioner.

O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Certiorarified Mandamus calling for the records made in the order in Na.Ka.No.A3/3806/2021 dated 14.09.2023 passed by the second respondent, quash the same, consequently, direct the first respondent to vacate the tenth respondent from the premises situated at Samathuvapuram, Door No.6/167, Plot No.2, M.Mettupatti Village, Erumaipatti Panchayat Union, Mohanur Taluk, Namakkal District and hand over the physical possession to the petitioner. 2.The learned counsel appearing for the petitioner submitted that the petitioner was allotted Plot No.2, M.Mettupatti Village, Erumaipatti Panchayat Union, Mohanur Taluk, Namakkal District under the Periyar Samathuvapuram Scheme and patta was also granted in favour of the petitioner, however, the tenth respondent has encroached the said premises.

3.The learned Government Counsel submitted that since the petitioner did not reside in the allotted premises, the patta granted in favour of the petitioner was cancelled and also produced a copy of the cancellation order for perusal of this Court. 4.In view of the above, this writ petition is closed. Liberty is granted to the petitioner to challenge the cancellation order in the manner known to law. No costs. Consequently, the connected miscellaneous petitions are closed.
