The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 4(1)(A) of the Tamil Nadu Prohibition (Amendment) Act, 2014 in Crime No.374 of 2024, seeks anticipatory bail.
2.The case of the prosecution is that the second accused was found in illegal possession of 26 bottles of Brandy. The petitioner/A2 purchased those bottled from a TASMAC shop and instructed the the first accused to sell them. Hence the case.
3.The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case only for statistical purpose. The learned counsel further submitted that the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. Hence, he prayed for grant of anticipatory bail to the petitioner.

4.Learned Government Advocate (Criminal Side) appearing for the respondent police while opposing for grant of anticipatory bail to the petitioner submitted that the petitioner is A2 in this case and he has three previous cases, which are similar in nature.
5.Heard both sides and perused the materials available on record. 6.Taking into consideration the facts and the submissions made by the learned Government Advocate (Criminal Side) and considering the fact that the petitioner has three previous cases, which are similar in nature, this Court is not inclined to grant anticipatory bail to the petitioner. 7.Accordingly, the Criminal Original Petition stands dismissed. 21.11.2024 sai 2/3
