The applicants seeks a direction to accept the succession duty paid by way of Court fee stamp papers by converting the same as a deposit made in terms of Section 379 of the Indian Succession Act.

2. In respect of petitions for grant of succession certificate, succession duty is required to be remitted to the Reserve Bank of India and a challan obtained in respect thereof. The applicants states that Court fee stamps were purchased inadvertently. The solution for this problem would be by directing refund of the Court fee so as to enable the applicants to use the same money to remit succession duty in the relevant account of the Reserve Bank of India. Accordingly, this application is disposed of by directing refund of Court fees to the applicants to enable further action as indicated above.
