C.S. No.438 of 2015 and OA. No.580 of 2015 and TOS. No.5 of 2017 (OP. No.218 of 2016) P.B.BALAJI, J., Today, this matter is listed under the caption 'for being mentioned'.

2. Learned counsel for both sides submit that the last but one sentence of the Common Judgment dated 04.07.2023, passed by this Court in C.S. No.438 of 2015 and TOS. No.5 of 2017, namely, "Court Fee is ordered to be refunded to the plaintiff as per law" should be modified and it is made clear that "Court Fee is ordered to be refunded to the plaintiff as per law only in respect of C.S.

No.438 of 2015 alone". Hence, the Registry is directed to modify the the said sentence from the Common Judgment dated 04.07.2023.

Except for the aforesaid modification, judgment dated 04.07.2023, remains unaltered in all other respects.
