Though certain conditions in the Bid Evaluation Criteria in the Tender document were the subject matter of challenge before the Writ Court, it appears that a concession was made seeking only consideration of the petitioners' representations with reference to those conditions. Acting upon the concession, the Writ Court had directed the authorities to consider the representations of the petitioners and pass appropriate orders thereon.

2. It is now stated that the letter of award has been issued to certain third parties, and thereafter, the representations of the petitioners were 2/5

rejected. Of course, Mr. AR.L.Sundaresan, the learned Additional Solicitor General, instructed Mr. Mohammed Fayaz Ali, the learned counsel appearing for the respondents, would submit that the rejection of the representation was prior to the letters of award.

3. In view of the above subsequent developments, we do not think anything survives in the appeal. Leaving it open to the petitioner to question the grant this Writ Appeal is dismissed. Consequently, the connected Miscellaneous Petition is closed. No costs.
