O R D E R

This petition has been filed seeking directions to the respondents 1 to 3 and their subordinates not to harass the petitioner. Learned counsel for the petitioner would submit that the fourth respondent filed a suit against the petitioner for recovery of possession and pending suit, he also filed a complaint before the respondent police on 18.10.2024, based on which, the petitioner was summoned on 26.10.2024. The petitioner appeared before the respondent police on 27.10.2024, where the petitioner was forced to surrender possession of the property, which is in dispute. Therefore the petitioner has filed the present petition seeking not to harass the petitioner.

Learned Additional Public Prosecutor for the respondents 1 to 3 would submit that based on the complaint given by the fourth respondent, the respondent police issued summons on 26.10.2024 and the petitioner also appeared on 27.10.2024. There is no harassment by the police officials as alleged by the petitioner.

Heard the learned counsel appearing on either side and perused the materials available on record.

It is seen that based on the complaint given by the fourth respondent, the respondent police summoned the petitioner on 26.10.2024 and the petitioner appeared before the respondent police on 27.10.2024. But the present original petition filed on 29.10.2024. Admittedly there is civil suit pending between the petitioner and the fourth respondent. There is no harassment as alleged by the petitioner.

Accordingly, this criminal original petition stands dismissed. However, the petitioner is at liberty to workout his remedy in the manner known to law.
