W.M.P.No.33523 of 2022 in W.P.No.5282 of 2017 W.M.P.No.33523 of 2022 in W.P.No.5282 of 2017 M.S.Ramesh.J., When this Court, by an order dated 22.09.2021 passed in WMP.No.22166 of 2018 in WP.No.5282 of 2017, had ordered for payment of the last drawn wages under Section 17(B) of the Industrial Disputes Act, 1947, from 24.02.2017 onwards, the Hon'ble Division Bench of this Court, had stayed the interim order passed by this Court dated 22.09.2021, through an order dated 18.11.2021 passed in WA.No.2824 of 2021, on condition that the Management deposits the entire arrears of the last drawn wages.

2. Now the petitioner claims payment of the last drawn wages for the subsequent period from 23.09.2021. Since the earlier order passed by this Court was for a direction to the Management to pay the last drawn wages from 24.02.2017 'onwards', the same would include the monthly last drawn wages also and therefore, the petitioner cannot justify the claim that the earlier order passed by this Court on 22.09.2021, was only for a period till the filing of the Writ Petition. Thus, the only remedy available to the petitioner is to approach the Hon'ble Division Bench to ventilate his grievances.

3. Accordingly, the Writ Miscellaneous Petition stands closed, with liberty to the petitioner to workout his remedy before the Hon'ble Division Bench with regard to this claim for the last drawn wages. 06.04.2023 Sni https://www.mhc.tn.gov.in/judis
