Comp.A.No.616 of 2022 Company Application No.616 of 2022 in C.P.No.178 of 2015 KRISHNAN RAMASAMY, J.

This Application has been filed for recovery of a sum of Rs.4,46,295.89 based on the statement of affairs filed along with the list of borrowers "Loans and Advances" as on 29.10.2019. Subsequent to the filing of the Statement of Affairs by the Ex.Directors, the Official Liquidator has issued Demand Notice dated 21.07.2022 to the respondent. The said notice was acknowledged by the respondent on 23.07.2022, but, there was no reply from the respondent till 09.10.2022. Therefore, the Official Liquidator has also issued Final Notice dated 10.10.2022 demanding a sum of Rs.2,00,000/- along with interest @ 18% p.a from 29.01.2016, but, the same was returned as refused by the respondent. In these circumstances, the application came to be filed for recovery of the amount.

2. This Court, by its order dated 23.12.2022, ordered notice to the respondent and the same was refused. It appears that the respondent is not interested to prosecute the matter. Hence, the respondent is set ex parte. https://www.mhc.tn.gov.in/judis

From the perusal of the materials placed before this Court and upon hearing the learned counsel appearing for the applicant and the statement of affairs filed by the Ex.Directors, this Court is satisfied that the respondent is liable to pay a sum of Rs.4,46,295/- as on 30.11.2022.
